Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the SME Sabah App (“App”), operated by SME Sabah. By registering, accessing, or using the App, you agree to comply with these Terms.

1. Definitions

  • “App” refers to the SME Sabah mobile application.
  • “User” or “Member” refers to an individual who has registered and obtained access to the App.
  • “Merchant” refers to businesses participating in the SME Sabah App Benefits program.

2. Eligibility
The App is available exclusively to registered SME Sabah members with valid login credentials. Users must be at least 18 years old. SME Sabah reserves the right to verify eligibility at any time.

3. Account Registration & Security
Users must provide accurate, complete, and updated information when registering. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. SME Sabah will not be liable for any unauthorized use of your account.

4. Membership Benefits
Through the App, members may access exclusive promotions, offers, and privileges from participating merchants (“SME Sabah App Benefits”). The availability, details, and redemption of such benefits are subject to merchant-specific terms.

5. Permitted Use
The App is provided solely for personal and non-commercial use by members. You agree not to:

  • Use the App for unlawful or fraudulent purposes.
  • Copy, modify, reverse-engineer, or distribute the App or its content without written permission.
  • Misrepresent your identity or membership.

6. Redemption of Benefits
To redeem benefits, members must present their digital Membership Card within the App at participating merchants. Additional conditions (e.g., proof of purchase, minimum spend) may apply, as determined by the merchant. Expired benefits will not be honored.

7. Non-Transferability
App access and membership benefits are personal to the registered member. They cannot be transferred, sold, exchanged, or redeemed for cash unless expressly permitted by SME Sabah or the merchant.

8. Privacy & Data Use
By using the App, you consent to the collection, storage, and use of your personal data in accordance with the SME Sabah Privacy Policy. Your data may be shared with participating merchants solely for benefit redemption and program management purposes.

9. App Availability & Technical Issues
SME Sabah strives to ensure the App is available and functional. However, we do not guarantee uninterrupted access and are not liable for downtime, errors, or technical issues. Reasonable efforts will be made to restore service promptly.

10. Disclaimer & Liability
SME Sabah does not provide goods or services under the benefits program. All products, services, and offers are provided by merchants, who are solely responsible for their quality, availability, and fulfillment. SME Sabah is not liable for disputes, losses, or damages arising from member interactions with merchants.

11. Intellectual Property
All content, design, logos, and materials in the App are the property of SME Sabah or its licensors. Unauthorized use is prohibited.

12. Suspension & Termination
SME Sabah reserves the right to suspend or terminate a member’s App access if these Terms are violated, if false information is provided, or if misuse is detected.

13. Program & Terms Modifications
SME Sabah reserves the right to amend, suspend, or terminate the App or benefits program at any time without prior notice. Updated Terms will be published in the App, and continued use constitutes acceptance.

14. Governing Law
These Terms are governed by and construed in accordance with the laws of Malaysia.

15. User Agreement
By registering for or using the SME Sabah App, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

Privacy Policy

This Privacy Policy explains how SME Sabah (“we”, “our”, “us”) collects, uses, stores, and protects your personal information when you access or use the SME Sabah App (“App”). By using the App, you consent to the practices described in this Policy.

  • With Participating Merchants: To validate and process benefits you choose to redeem.

  • For Legal Compliance: If required by law, regulation, or legal proceedings.

We do not sell or rent your personal information to third parties.

4. Data Storage & Security
We implement reasonable technical and organizational measures to protect your information from unauthorized access, misuse, alteration, or disclosure. Data is stored securely and retained only for as long as necessary to fulfill the purposes described in this Policy or as required by law.

5. Cookies & Tracking Technologies
The App may use cookies or similar technologies to enhance user experience and analyze usage patterns. You can manage your cookie settings through your device, though some features may not function properly without them.

We may update this Privacy Policy from time to time. Updates will be published in the App, and continued use constitutes acceptance of the revised Policy.
